L&L obtains dismissal of a putative class action suit for Moscot.com

L&L obtained a dismissal of a putative class action suit for Moscot.com, LLC in the U.S. District Court for the Southern District of New York. Our firm represented the luxury eyewear brand against allegations that Moscot's website violated the Americans with Disabilities Act and the New York City Human Rights Law. In its March 5, 2026 Opinion and Order, the Court held that the case could not proceed because Moscot demonstrated that the alleged accessibility issues had been addressed and that meaningful measures were in place to maintain accessibility going forward.

The Court specifically credited Moscot’s evidence showing that it had invested substantial time and resources into improving the accessibility of its website, worked with a leading accessibility provider to investigate the alleged barriers, remedied the issue identified through that process, and implemented ongoing compliance measures. On that record, the Court concluded that it was “absolutely clear” the challenged conditions would not recur, dismissed the federal claims, declined to exercise supplemental jurisdiction over the remaining state-law claim, and dismissed the case. This result reflects our firm’s deep experience with Website accessibility actions, and judgment about when to make use of strategic motion practice versus when to settle such claims.
